1.  Acceptance of Terms
By using the site and the Service, you agree to be bound by the following agreement between you and Lifestyle Ergonomics Pty Ltd ABN 73 100 901 755 governing your access to, browsing and/or use of our website (www.lifestyleergonomics.com.au) and your use of our online purchasing facility. You also agree to comply with all applicable laws and regulation.

We reserve the right, at our discretion, to update or revise these Terms of Use by posting the new version on the Site at any time and without separate notice to you. Your continued use of this Site or the Service after we post any changes to these Terms of Use constitutes Your agreement to those changes.

2.  Your Warranties and Obligations
By using the Site and the Service you warrant that you are over 18 years of age.

This site contains material which is subject to protection under Australian and international copyright and other laws governing protection of intellectual property rights. You may not sell. license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, create derivative works from, adapt, or edit such materials.

However, you may copy (either electronically or in hard copy) material on the Site only for use in conjunction with the Service.

3.  Disclaimers and Limitations to Liability
The material contained in this Site is provided on an "as is" basis. To the maximum extent permitted by law, we disclaim all representations and warranties, express or implied, with respect to such material.

4.  Indemnity
You agree to indemnify, and hold harmless Us and Our employees, contractors, officers and agents from all liabilities, claims and expenses, including legal fees that arise from the use or misuse of this Site or the Service, by you or by other people. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defences.

5.  Your information and Privacy
You are entirely responsible for the information that you send to us. We are not liable for errors or omissions in the information that you submit. In particfular, we will not be responsible for delays, non-responses or non-delivery where you have provided the wrong address or contact details.
We are committed to protecting your privacy. We will not sell, trade or rent your personal information to others.
When you register as a user, we need to know your name, email address and mailing address. This allows us to process your registration.
When you make an online payment, you must make the payment through the secure server of our financial institution. They may need to know you name, email address, mailing address, credit card number and expiry date. This allows them to process your purchase. We do not see your credit card information.

6.  Links to Third party Sites
This site may provide links or references to other sites for your convenience. We do not control or endorse these sites, and are not responsible or liable for the accuracy, legality, or any other aspect of the content of such sites or for any damage or injury arising in connection with your access to such sites.

7.  Termination of Access
If we in our absolute discretion that you have committed a breach of these Terms and Conditions, in particular the user Warranties and Obligations, we may immediately and without further notice to you, suspend your use of the Site and Service and delete any data associated with your account.

8. Warranty Conditions
All warranty claims will be assessed to ensure that products have been subkect to normal 'wear and tear'. Any claim which is adjudged to have been caused by misuse or abuse will not be considered as a warranty repair.

Mechanisms rated for 5 years are covered for use at a rate of 8 hours per day, 5 days per week.
Mechanisms rated for 10 years are covered for use at a rate of 24 hours per day, 7 days per week.

Upholsteries are not covered by warranty - all fabrics supplied are covered by the respective warranty policy of the relevant upholstery supplier. 

ONLINE PURCHASE TERMS
By ordering from us, you agree to purchase a product or products and be bound by the following agreement between you and Lifestyle Ergonomics Pty Ltd governing your purchase of our products.

1.   Product Information

• We will use reasonable endeavours to ensure that all product information is accurate. However, it is your responsibility to verify that the product you have selected is suitable for your intended purposes.
• Please note that in some cases the product may look different from the illustration posted on the site because of slight colour variations or the way it appears on your screen.
• If for any reason you are unable to complete your purchase successfully, please contact our technical support at office@lifestyleergonomics.com.au.

2.   Pricing Information

• You acknowledge that despite our reasonable precautions, products may be listed at an incorrect price.

3.  Your Obligations

• Your must complete payment online at the time of ordering unless you have made a separate agreement with us for payment terms.
• To cancel an order you must contact us immediately by fax to (02) 4927 5800 or email to office@lifestyleergonomics.com.au.
• We cannot cancel orders once the product has been shipped.
• We cannot cancel orders once the order has been placed with our manufacturer.
• We cannot accept cancellations for any reason for custom made orders once the order is placed with our manufacturer.

You indemnify us for all losses resulting from your cancelling an order

We reserve the right to charge an administration levy of up to $50 for any cancellation

4.  14 Day Returns Policy
Within 14 days of delivery, you can contact us to return a product if the product is:

• defective
• still in new and original condition i.e. original tags attached, not soiled or marked.
• You arrange for the product to be returned to us
• We will refund your freight costs for returns of faulty products
• We will then arrange for either a refund or replacement, normally within 7 working days of receipt 

We cannot accept the return of any Product which is not in new and original condition, unless it is faulty and returned in accordance with the procedure outlined above. If you have paid using a credit card, any refund will be done as a credit to your credit card account for the amount in question.

STANDARD EQUIPMENT TRIAL AND EVALUATION
Terms and Conditions

I acknowledge and agree that the loan equipment will be returned to Lifestyle Ergonomics no later than 5:00pm on the date specific in the agreement. If I do not return the equipment by the agreed date, I understand that this Loan Agreement will become a Rental Agreement and agree that I will be bound by Lifestyle Ergonomics’ Standard Rental Terms and Conditions, a copy of which I may obtain from Lifestyle Ergonomics on request. In this event, I agree to pay the hire rate stated above for this equipment.

I also agree to take good care of the loaned equipment and to return the same condition as it what when I received it. Should there be any damage to the equipment during the time it was on loan to me, I agree to pay the cost of any necessary repairs or the cost of replacement if repair is not possible.

STANDARD EQUIPMENT HIRE
Terms and Conditions
Equipment means any ergonomic aids or any other goods of any kind whatsoever hired to the Customer from the Company

• The hire period shall commence on the first day of hire as specified in the Hire Agreement. Period shall end on the last day of hire as specified in the Hire Agreement
• Charges will be applied at the rates specified in the Hire Agreement
• Rates are applied for each weekly or monthly period or part thereof commencing at 8.30am on the first day of hire.
• Loan equipment must be returned in the same condition as it was when received
• Should there be any damage to the equipment during the time it was on loan, all costs necessary for repairs or replacement will be incurred by the parties stated in the Loan Agreement.
• The customer must not repair or in any way alter any part of the equipment without the written permission of the Company
• Should the equipment develop any fault whilst in the possession of the Customer the Customer shall immediately notify the Company stating the nature of the fault. The Customer shall in no circumstances carry out any repairs to the Equipment or allow any such repairs to be carried out without the express written permission of the Company.

HIRE CHARGES
- Chairs / Legrest / Sit-Stand Stool / Saddle seats - $20 per week
- Nomus mouse - $15 per week
- Other computer accessories (mouse, forearm supports, keyboards, etc) - $10 per week
